The updated rent is not payable until the month after written notice (article 18.2). Enter the date in the panel below to see when it starts.
The notice has to state the percentage applied and, if you require it, enclose an INE certificate. A note on the previous month’s receipt is valid.
The INE index falls below the CPI ceiling, which is why it is the one that binds: additional provision 11 sets it as the “reference limit for the purposes of article 18”.
The reference month is not your anniversary month, and the DAY changes it: article 18.1 takes the last index published on that day, and the INE publishes in mid-month.
This is for residential lettings. A shop, an office or a seasonal let falls under article 4.3 of the Act, which leaves it to whatever the parties agreed, without this ceiling.
When were you notified in writing?
Article 18.2 makes the updated rent payable “from the month following” the written notice. With no notice there is nothing extra to pay, and a late notice cannot be backdated.
